The Samkharauli Bureau was guided by the order of 1978 - says the "Empathy" center while evaluating the statements of the Minister of Justice, Rati Bregadze, who said that according to Samkharauli, the diagnoses made by the "Empathy" center are not reliable.
"The legal basis for the preparation of the conclusion is questionable and indicates the biased status of the Ministry of Justice. Such action in the case of another prisoner is unknown to us.
As of 08/12/2022, the gastroenterological and neurological diagnoses correspond to the diagnoses made in the "Vivamed" clinic or in the Gori hospital, therefore, the minister's statement is not true.
As for psychiatric diagnoses: it was confirmed by 4 psychiatrists (2 Georgian psychiatrists, 1 American and 1 English psychiatrist), as well as 1 Georgian and 1 American neurologist: based on clinical, anamnestic/catamnestic, psychometric, clinical-psychological and instrumental studies. The opinion of the expert group of the Public Defender was also confirmed by diagnosis N7 (06/12/2022), which was also submitted to the court. It is also unclear how a psychiatric examination could judge the mental state of a living person without a personal examination.
As for the statements of experts on "torture", according to the Minister of Justice, that it "does not comply with the Georgian legislation" - the Minister of Justice means: USSR law N1208, st. Moscow 1978, which still leads the Samkharauli Bureau.
Here we once again inform the public that the State Investigation Service is conducting an investigation into the facts of the improper treatment of Mikheil Saakashvili in the penitentiary system, where the Minister of Justice and the head of the penitentiary service, including the current head of the medical service Urtkhmelidze, who was in charge of the Gori Hospital at that time, are possible figures. Accordingly, they represent a party.
Finally, the "Empathy" center is still waiting for the conclusion of the Samkharauli Bureau, after getting acquainted with the above, a group of experts will hold a press conference, as well as an examination of the conclusion with the participation of international experts.
We consider the actions of the Minister of Justice Rati Bregadze as an attempt to put pressure on the non-governmental organization center "Empathy" and the group of experts, as well as an attempt to influence the court, an attempt to discredit and damage the reputation of local and international experts.
