Nika Melia, the chairman of the National Movement, has been summoned to the Prosecutor's Office, and the reason for the summons is unpaid bail, - the Chief Prosecutor's Office of Georgia has issued a statement.
On November 1, 2020, during an anti-election fraud rally near the parliament building, Nika Melia removed his electronic monitoring bracelet. According to the prosecutor's office, Nika Melia's move "practically ruled out the existence of legal guarantees of proper conduct imposed on him by law."
"Accordingly, the motion of the Prosecutor's Office requested the tightening of the measure of restraint, in particular, the increase of the bail to 100,000 GEL.
By the decision of the Tbilisi City Court of November 3, 2020, the measure of restraint previously applied to the accused Nikanor Melia was tightened and the bail increased to 40,000. According to the same decision of the Tbilisi City Court, the term of payment of the increased amount of bail of Nikanor Melia - 40 000 GEL - was set at 50 days. He was also prohibited to cross the state border without the prior notice and consent of the prosecution.
According to the Criminal Procedure Code of Georgia, after determining the amount of bail, the accused, or another person on his behalf or in his favor can deposit both cash and real estate equivalent to this amount.
Although the accused Nikanor Melia owns real estate sufficient to secure bail, and according to his declaration filed on December 31, 2020, he had sufficient money to secure bail in December, the accused did not fulfill the condition of restraint by the deadline set as December 24, 2020, he had not paid the bail, nor had he provided collateral equivalent real estate, the statement said.
The same statement says that Nika Melia will be given an additional one week, and in case of non-payment of bail within this week, the prosecutor's office will request his arrest. A protocol will be signed, according to which he will be given an additional one week to pay the bail.
It is also clarified that in case of non-payment of bail, or if he does not provide the bail with equivalent real estate, the prosecution will apply to the court to change the measure of restraint chosen for him to imprisonment, "- is said in the statement.
