The number of arrests requested by the Prosecutor's Office is growing every year – GYLA

Georgian Young Lawyers Association has presented the results of a 4-year monitoring of criminal proceedings. The report also focuses on the increase in the demand for detention on remand by prosecutors as a measure of restraint.


According to the report, the decision on detention as a measure of restraint is often not supported by compelling arguments. Unjustified imprisonment is also common.


"As a result of GYLA monitoring, it has been revealed that the rate of detention requested by the prosecutor's office is increasing every year. The most alarming in this regard was the data recorded in the reporting period 2019-2020, which, compared to the previous reporting period, has increased by 6 percentage points. Prosecutors sought custody of 454 (66%) of the 686 defendants. Of these, the court rejected 116 (26%) motions.
It should be positively assessed that compared to the period from March 2018 to February 2019, the rate of meeting the  detention requests of  the prosecution by the court decreased by 8 percentage points. However, it should be noted that during the reporting period 2019-2020, the number of cases of unjustified detention increased by 6 percentage points,” - reads the report.

According to the organization, "the increase in cases of unjustified detention proves that the court still does not consider this type of measure of restraint as the most severe measure, which should be used only in extreme cases."
