According to the Chairman of the Parliament, Archil Talakvadze, they are willing to take into the account the call of partners and send the approved law on common courts to the Venice Commission for final revision.
“Although the consistency of the new regulations with the recommendations of the Venice Commission is the easiest to determine, naturally, we are ready to take into account the call of the partners and send the law to the Venice Commission for final revision.
"Democratic reforms are a common achievement of our country, government and society, and Georgia continues to move forward!," - says Archil Talakvadze.
According to him, after the amendments, the law reflected three additional recommendations of the Venice Commission regarding the procedure:
• "According to the recommendation of the Venice Commission, the procedure should be fully open and public. This recommendation is fully reflected in the organic law. In particular, according to the new norms, all the assessments and decisions of each member of the High Council of Justice regarding each candidate will be published immediately, indicating the identities of the relevant members of the Council;
• According to the recommendation of the Venice Commission, candidates should be allowed to appeal twice against the decision of the High Council of Justice. According to the new rules, a candidate may re-appeal both the scores given by the council members and the final decision on the nomination. Accordingly, the aforementioned recommendation of the Venice Commission is also carefully considered;
• Finally, according to the recommendation of the Venice Commission, the decision to nominate a candidate should be strictly in line with the scores obtained by him. This recommendation was fully reflected in the organic law. In particular, the new rules at all stages of the procedure completely exclude the preference of a candidate with a relatively low score over a candidate with a relatively high score.."
