Nika Gvaramia is demanding to evade the judge. A few minutes ago he filed a petition with the Tbilisi City Court.
It emerged that one of the witnesses, Zaza Gvelesiani, representing the victim company, was a childhood friend of the judge and was excluded from the list of witnesses to be questioned by the judge.
Judge Lacha Chkhikvadze confirmed his friendship with Zaza Gvelesiani: "He is a childhood friend, we have communication in the content of friendship, we often meet," he said.
Nika Gvaramia questioned him on the matter and asked why he did not explain that the man who was a witness in the case was his personal friend:
"Why did you not explain that the witness in the case is your personal friend with whom you have a personal relationship and the ability to share information. At the same time, even if this person was not on the witness list, he represents the company that has been identified as the victim," Nika Gvaramia told the judge.
As evidence, Nika Gvaramia submitted joint photos of the judge and the witness.
He explains that the judge cannot be considered impartial in the circumstances, hence his decision cannot be fair either.
According to the judge, when the issue would be raised and Zaza Gvelesiani was announced for questioning, he may have explained. As for the question of on why the issue was not raised and why Gvelesiani was excluded from the list of those questioned, the judge explains:
"The prosecution, along with other witnesses, unequivocally accepted the trial in which Mr. Zaza participated as a defence evidence format," the judge said.
