"Make the questions public" - According to Okhanashvili, the Ombudsman sent incorrect or incomplete information to the OSCE/ODIHR

"Questions sent by the Public Defender should be made public to clarify the information on the basis of which the OSCE/ODIHR has drawn conclusions about the changes concerning the Office of the State Inspector!" - This was the reaction of the Chairman of the Legal Affairs Committee Henri Okhanashvili to the OSCE/Odier report of 18 February 2022.

The report refers to the abolition of the State Inspector's Office. Okhanashvili suspects that the OSCE/ODIHR was not provided information on some issues. For example, "How compatible is the function of control over legality of investigative actions and personal data processing in the hands of one state service".

According to Okhanashvili, the fact that the OSCE/ODIHR was provided significantly incorrect or incomplete information is also confirmed by legal inaccuracies in the report.

"In the OSCE/ODIHR report we read that the quorum for the election of two newly appointed officials by the Parliament seems to have decreased, which in fact is not true and can be easily checked in the Rules of Procedure of the Parliament of Georgia. The report also says that the mechanisms of parliamentary control over these officials have been abolished, which is also not in line with the Rules of Procedure of the Parliament of Georgia!

According to Anri Okhanashvili, in order to ensure impartiality of the Special Investigation Service, those who, for example, have extensive background in the police and/or security services should not be elected to the position of the head of the Service.

"From this we can see that the OSCE/ODIHR is practically questioning the legitimacy of the current state inspector leadership based on their experience! I wonder if any information has been provided to the OSCE/ODIHR that the still active leadership of the State Prosecutor's Office could have participated unhindered in the new competition and that they did not take advantage of this opportunity! We hope that the Public Defender will be guided by the principle of transparency and make public the questions she sent to the OSCE/ODIHR so that our society can draw accurate and objective conclusions!" said Ohanashvili.
