Nika Gvaramia, CEO of the Mtavari Channel, says he still does not know who is suing him in the Rustavi 2 case, who is the bearer of the public interest, whose rights appear to have been violated. He spoke on the subject at the Court of Appeals.
According to him R2 is not a collection of people and does not exist independently of the founders.
According to his own assertion, if any concealment of property is started, it is not by the director of the company, but its owners, and the director can only be the "executor," which the parties in the dispute are not talking about today.
"I don't understand who is suing, the state is, which has replaced the legal person in the definition of legal person, those people, the only circle of people to whom I was liable. I'll tell you more, if a minority shareholder applies for criminal liability, he should also sue the majority partners for knowingly causing harm to the company. I am not criminally liable even with a minority shareholder, if he is not arguing at all, for causing harm to the company, which the CEO cannot do. [...]
In addition to this I would like to remind you that the civil suit against me, namely the civil suit is the determining factor here and not some application filed with the prosecutor's office, I don't know in what form, bypassing the supervisory board, some Paata Salia decides as a newly appointed CEO that, if possible, to study the case of Gvaramia. What is this, the control chamber was called? there was no audit and nobody talked to the supervisory board. [...] to this day I do not know who R2 is to be arguing with me, who are the people to whom I violated my responsibility and abused my position," said Nika Gvaramia.
According to him, he can be held criminally and civilly responsible only to those people, who were founders during his leadership, who don't exist.
